Job Description:
General Counsel Division, Health and Human Services Section
The Oregon Department of Justice is seeking applicants for a position in the Health and Human Services Section of the General Counsel Division. The position will be based in Salem, with opportunities for some remote work. The Health and Human Services Section provides legal advice, contract review, and administrative rule and hearing services to client agencies administering the state's public assistance, health and social services programs, and both adult and child care facility regulation to the following agencies:
  • Oregon Department of Human Services (ODHS) – programs for adults and people with disabilities, licensing and adult abuse oversight, public assistance benefit programs including Medicaid, temporary assistance for needy families (TANF), supplemental nutrition assistance (SNAP) and vocational rehabilitation;
  • Oregon Health Authority – medical assistance programs (including managed care through Coordinated Care Organizations), Oregon Prescription Drug Program, addictions and mental health, public health, licensing, health analytics, and the Oregon State Hospital;
  • Home Care Commission;
  • Department of Business and Consumer Services – insurance regulatory programs, Division of Financial Regulation and the Oregon Health Insurance Marketplace;
  • Department of Education, Early Learning Division, Office of Child Care; and
  • Psychiatric Security Review Board.
Work in the section is fast-paced and provides a stimulating and rewarding opportunity to advise ODHS and other agencies on a variety of health- and social-related programs impacting some of the most vulnerable populations within the state. Typical assignments include providing general counsel advice involving statutory and administrative rule authority, public benefit programs including Medicaid, TANF, SNAP and state-funded programs; drafting of administrative rules; representation of ODHS in administrative licensing and other regulatory hearings; and presentation of trainings as requested by ODHS. The successful candidate will represent ODHS in program areas including Adults and Persons with Disabilities; Office of Developmental Disabilities; Office of Training, Investigations and Safety; and Vocational Rehabilitation. The attorney in this position may also be assigned other clients and responsibilities.

Required
  • Active membership and in good standing with the Oregon State Bar by the time of appointment.
  • At least two (2) years of practical experience.
  • Possess superior analytical, advocacy, research, verbal communication, and writing skills.
  • Strong work ethic.
  • Litigation skills or a desire to develop the skills.
  • Client counseling skills.
  • Collaborative work history with lawyers, non-lawyers, policy makers and stakeholders.
  • Demonstrated commitment to diversity, equity, and contributing to an inclusive working environment where diverse individual experiences and perspectives are valued and supported.
Desired Experience
  • Litigation experience in the administrative law context.
  • Familiarity with general government law including public records and public meetings, public contracting law, and administrative law.
  • Familiarity with health law including HIPAA and public assistance benefit programs including Medicaid.
  • Ability to efficiently and thoroughly review and provide legal advice on contract documents.
  • Demonstrated willingness and ability to work with clients effectively, cooperatively, and on tight timelines in a high-volume practice.
  • Demonstrated willingness and ability to work independently and manage a busy and ever-changing list of assignments while keeping managers and clients informed of the status of projects.
  • Familiarity with Oregon’s intellectual/developmental disability, physical disability or senior programs.
  • Demonstrated commitment to public service.

This OAJA-represented position will be filled at either the Assistant Attorney General or Senior Assistant Attorney General level, salary range $7,792.00 - $15,130.00 per month, depending primarily on years of legal practice experience and other factors. Employees who are Public Employee Retirement System (PERS) participating members will have their base salary increased by 6.95% and pay a 6% employee contribution to PERS; the salary range noted reflects base salary only.
