Department: Administrative Office

Supervisor: Director of Operations

General Description Advises management concerning legal rights, statutes, regulatory and compliance matters.
Interprets laws, rulings, and regulations for the company.

Examines legal data to determine advisability of defending or prosecuting lawsuit.

Acts as agent of corporation in various transactions.

Represents the company in litigation and other legal proceedings.

Studies statutes, decisions, and ordinances of quasi-judicial bodies.

Human Resources

General Description:

Support employee relations, talent acquisition, compensation, benefits, workers compensation, and policy alignment and compliance. Serve as catalyst in driving culture of continuous improvement by being service oriented, project management, and deploying best practices across the Company to improve cost, quality, and employee engagement.

Responsibilities:

  • Assists with ensuring job requirements and job descriptions for all positions meet legal requirements and compliance.
  • Counseling managers on candidate selection; conducting and analyzing exit interviews; recommending changes.
  • Organize and supervise Workers Compensation Program and process legal documents. Develop and ensure compliance to compensation policies and procedures. Manage employee injury cases and oversee all investigation claims for various parties. Participate in all worker compensation hearings. Analyzed inquiries and complaints and assisted in resolving all complaints. Maintain records for all worker compensation claims and related activities.
  • Ensures planning, monitoring, and appraisal of employee work results by training managers to coach and discipline employees; scheduling management conferences with employees; hearing and resolving employee grievances; counseling employees and supervisors.
  • Ensures legal compliance by monitoring and implementing applicable human resource federal and state requirements; conducting investigations; maintaining records; representing the organization at hearings.
  • Maintains management guidelines by preparing, updating, and recommending human resource policies and procedures.
  • Maintains and audit human resource records by designing a filing and retrieval system; keeping past and current records.
  • Maintains professional and technical knowledge by attending educational workshops; reviewing professional publications; establishing personal networks; participating in professional societies.

Employee Relations Consulting:

  • Act as advisory resource and provide legal consult to HR on employee relations matters and cases
  • Collaborate with HR on strategic employee relations plans and approach
  • Work with HR on policy updates and provide State and Federal legal updates regularly to HR to ensure compliance
  • Coordinate employee relations litigations cases and act as liaison between HR, external litigation firm, and claimant
  • Review and provide consult on employee relations corrective action documentation and employee communications material
  • Work with and consult HR and external immigration law firm on any immigration issues
  • Assist in reviewing and updating personnel policies and procedures in accordance to Federal and State requirements as well as current and future labor laws

Basic Qualifications

  • Bachelor’s degree or MBA
  • Juris Doctor Degree from accredited school
  • Admitted to the State Bar
  • 2 – 6 years of experience as an Attorney
  • Candidates should have familiarity with federal court practice, as well as with the Equal Employment Opportunity Commission, Department of Labor, and other federal, state and local government administrative agencies
  • Candidates should also have some litigation experience, including drafting responsive pleadings, handling all aspects of the discovery process, and drafting motions, including motions for summary judgment.

  • Interacting with the general public, often in adverse conditions; many residents and their families are under emotional stress dealing with issues of illness, hospice, death and grief.
  • Frequently changing conditions in which one must be attentive and able to respond appropriately.
  • Constant necessity to respond maturely and effectively with residents, families, staff and other professionals.
  • Appropriately represent the facility in dress and demeanor.
  • Regular work schedule is required. Minimum expectations: Employees are expected to be in the office working from 8:30AM to 5:00PM, Monday through Friday.

· May be required to lift, push, pull and move equipment and supplies in excess of thirty five pounds infrequently and occasionally objects in excess of fifty pounds.

  • Assist in the development and approval of policies and procedures relating to department duties.
  • Serve on committees as required by statutes and regulations or as requested by the director of operations.

  • Participate in selected continuing education programs if available.

  • Participate in quality assurance program and attend scheduled meetings.

Responsibilities

  • Understand and abide by established policies of the facility and interpret them to concerned parties.
  • Maintain confidentiality of information; maintain a professional demeanor.
  • Account for use of time, report sickness, and plan vacation and holiday time with administrator or appropriate supervisor.
  • Prepare all required reports and submit to administrator or appropriate supervisor.
  • Travel to alternate location is required as business demands.

Job Type: Full-time

Pay: $75,000.00 - $100,000.00 per year
