Case Management
Investigate nurse practice complaints and related issues referred to the agency by employers of nurses, nurse peers, the public, governmental agencies or other State Nursing Boards to determine if the Nurse Practice Act (Oregon Revised Statute 678 and Oregon Administrative Rule – Chapter 851) has been violated. Use professional knowledge of nursing standards of care in various clinical settings (acute, long term care, community based care facilities, etc) and applies this knowledge throughout the investigatory process to determine violations and risks to public safety.
Prioritize cases based on the severity of the alleged complaint and level of risk to public safety. Uses independently judgement and exercising discretion, prepares Interim Consent Orders requesting licensees voluntarily discontinue practicing while the complaint is investigated for violations that indicate high public risk.
Investigations
Routinely works independently to gather facts and evidence about the complaint by scheduling and conducting interviews with licensees, witnesses, patients, employers, and others, as necessary, primarily at the Board office. Gather documentation, records and background information including criminal, civil, medical, and employment history, of the licensee. Prepare and issue subpoenas to obtain or inspect pertinent information (police reports, medical records, personnel records, etc.) on site or have information sent to the Board office.
Report Writing
Write detailed investigatory reports with findings of fact, citation of suspected violation of the Nurse Practice Act and disciplinary recommendation for Board action. If no suspected violation is determined, the case is placed on closed case agenda for Board review and disposition action.
Case Files
Enter relevant case information and documents into the database to track and monitor open cases to ensure accurate status, and timely resolution, of complaints (120 day – ORS 676.165). Maintain hard copy records according to program record retention and guidelines and ensure confidentially of disciplinary files.
Negotiate & Prepare Stipulated Consent Agreement
Evaluate all information and evidence obtained throughout the investigation to determine if a legitimate violation has taken place and document in investigative reports and database according to department standards. If there is a suspected violation of the Nurse Practice Act, investigator may prepare stipulated consent agreements with conditions as negotiated with licensees (by authority delegated by the Board) as an effort to help licensees voluntarily mitigate greater discipline by the Board, correct conduct and avoid additional public risk.
Board Presentation and Final Board Orders
Present cases to the Board and answer questions from the Board regarding the investigation during Board meetings. Prepare case evidence in consultation with the Assistant Attorney General and Investigations Manager for contested case hearings and testify as a witness at hearing, criminal, civil, or administrative proceeding as needed.
Prepare final notices, Board Orders, including findings of fact and conclusions of law following Board meetings to document action of the Board. Send copy of orders to all appropriate parties.
Project Administration
Recommend amendments to administrative rules related to the Nurse Practice Act (NPA) related to the investigatory processes and the investigator’s ability to carry out the Board’s public safety mission. Serve as staff member on Board committees.
May act as a lead for the team within the department on a need basis as assigned by manager.

MINIMUM QUALIFICATIONS

A Bachelor's degree in the profession (or the educational requirements for entrance into the profession) which the position regulates; AND
Five years experience as a licensed health care professional in the profession which the position regulates; AND
Oregon license in the profession which the position regulates (e.g., Registered Nurse, Nurse Practitioner, Dentist, Dental Hygienist, Pharmacist).
