DUTIES & RESPONSIBILITIES

The position is for an experienced paralegal to join our legal team supporting the in-house attorney responsible for whistleblower/ anti-retaliation matters. The candidate’s two primary responsibilities will be:


  • Supporting the BNSF’s in-house attorney who handles cases arising under federal whistleblower anti-discrimination laws (such as the Federal Railroad Safety Action, 49 USC § 20109, and OSH Act § 11(c)); and
  • Ensuring that legal papers served on BNSF (such as lawsuits and wage-garnishment notices) are promptly recorded and relayed to the correct employees for further handling.


Duties include:

  • Providing paralegal support for a sizeable docket of anti-retaliation cases. These duties include:
  • Creating the case file for each case by analyzing the initial complaint, identifying and gathering relevant documents and data, and organizing that information;
  • Managing the discovery process by analyzing incoming discovery requests, collecting and retaining responsive documents, and reviewing and preparing documents for production;
  • Keeping current, accurate records of each legal proceeding;
  • Keeping case files updated and controlling user access to each case file;
  • Assisting attorneys in the preparation and assembly of position statements, pleadings, and motions;
  • Calendaring litigation deadlines and events (such as depositions and motion-submission deadlines);
  • Assisting with depositions by drafting deposition notices, preparing witness-preparation materials, and scheduling witness-preparation sessions
  • Drafting basic legal documents, including internal hold order notices and pleadings (such as notices of appearance and notices of appeal);
  • Filing court documents in multiple jurisdictions and administrative forums; and
  • Using electronic billing software (CounselLink) for litigation budgets and invoice processing
  • Ensuring that legal papers served on BNSF (such as lawsuits, demand letters, and wage-garnishment notices) are promptly recorded and relayed to the correct BNSF employees for further handling. This responsibility includes working closely with BNSF’s registered agents.
  • Completing special projects and other duties as assigned


Performing the duties and responsibilities above requires frequent, effective communication and collaboration with individuals from other departments and at all levels of the company.


Occasional travel (2 -3 times per year) may be required to assist with trials or to attend conferences or training.


QUALIFICATIONS

The position requires an organized, self-motivated person who is able to prioritize multiple tasks, is personable, and works well in a team environment. The successful candidate will be a person who takes


ownership for the success of the team, shows attention to detail and acts with a high degree of professionalism and ethics.

Applicant must currently possess oone of the following:

  • Associates degree; or
  • Certification as a legal assistant/paralegal from an American Bar Association approved institution or certification as a legal assistant from the National Association of Legal Assistants.
  • Applicant must have at least 4 years of experience in a law firm or corporate setting, focusing on employment matters.
  • Applicant must have working knowledge of Lexis/Nexis research system and other web-based legal research tools and Microsoft Office suite, including SharePointe.
  • A Bachelor’s degree is preferred.
