Who we are:
The Public Defense Services Commission (PDSC) is a nine-member commission appointed by the Chief Justice of the Oregon Supreme Court that serves as the governing body for Oregon’s public defense system. The Commission provides policy direction and oversight for the administration of the system. As required by ORS 151.216(1)(b), the Commission oversees the Office of Public Defense Services (OPDS) that serves as the administrative agency responsible for carrying out the Commission’s directives and other statutorily defined duties. The legal services provided by OPDS represent an essential component of Oregon’s public safety system.
The mission of OPDS is to establish and maintain a public defense system that ensures the provision of public defense services consistent with the Oregon Constitution, the United States Constitution and Oregon and national standards of justice.
OPDS employs 113 staff. The office includes the Executive Division, the Compliance, Audit, and Performance Division, the Appellate Division (AD), the Trial Division and the Administrative Services Division. The agency negotiates contracts with trial level public defense providers and administers and distributes funds for representation and related services for cases during the biennium for criminal, juvenile, and civil commitment cases. The agency provides compliance and oversight to the trial community providers through quality assurance practices, training, and education. Financial Services processes all expenses related to representation in public defense cases. The Appellate Division provides direct legal representation in the state appellate courts in criminal cases, juvenile dependency and termination of parental rights cases, and parole cases. Other services in the agency include, Data Collection and Analysis, General Counsel, Human Resources, Information Technology Services, Internal Audit, and Policy Development.
The primary purpose of this position is to:
negotiate, manage, and administer public defense contracts valued at an agency aggregate of approximately $400 million. This includes but is not limited to gathering facts and information, performing analysis and evaluation, and providing recommendations on a wide variety of topics and projects related to the administration of public defense contracts that provide trial-level and appellate representation to financially eligible persons.
Duties:
Contract Services:
  • Negotiate public defense contracts with both attorney and non-attorney providers.
  • Develop statewide, regional, and county public defense proposals based upon priorities and directives established by the PDSC. Factors considered include system needs, statistical analysis, and budgeted resources.
  • Prepare proposals.
  • Negotiate and reach final agreement with contractors.
  • Work with General Counsel in drafting contract language.
  • Administer public defense services contracts. Communicate with each contractor in writing, by telephone, and in person to ensure that the contractor meets the requirements of each contract, including workload requirements, budget documents and reports, qualification standards, insurance requirements, PDSC best practices, and timely submission of caseload reports.
  • Work with OPDS General Counsel and contract providers to resolve issues regarding interpretation of contract language.
  • Work with trial courts to aid in the coordination of services provided by public defense providers and develop new procedures when appropriate.
  • Negotiate and prepare contract addenda necessitated by legislative changes, changes in caseload/workload, court procedures and charging practices.
Contract Analysis:
  • Perform analysis and evaluation of services; compare results to the policies, goals, and objectives of the agency; prepare findings and recommendations using both narrative and statistical reports.
  • Perform statewide statistical analysis in conjunction with Research Analyst needed to support contact needs, present findings to management and PDSC.
  • Evaluate and analyze contract proposals from various types of service providers to ensure quality representation in all cases filed in each county.
  • Factors considered generally include: the types of providers necessary to ensure efficient representation in each county each potential provider’s capacity to render quality representation; and the number and complexity of case types appropriate for each provider to ensure quality representation and stability of the public defense system.
  • Serve as a resource to courts and the Oregon Judicial Department (OJD) on a wide variety of issues and problems affecting individual courts or having statewide impact. Examples: Contract interpretation issues, Attorney appointment issues, and right to counsel issues.
  • Work with the court and providers to ensure appropriate application of PDSC’s established policies, develop solutions, and facilitate change as needed.
  • Work with Trial Division General Counsel and Deputy General Counsel to ensure correct application of federal and state laws, rules, and policies relating to a variety of subjects and issues which may have impact upon public safety system. Develop policies and procedures to comply with legislative changes; identify the need for new or revised statewide policies and procedures in areas of expertise; prepare draft policies and procedures, recommend their adoption, and assist in their implementation.
  • Maintain aggravated murder database and provide responses to requests for information. Assist Trial Division counsel and General Counsel with requests for information.
Outreach:
  • Solicit information from judges, trial courts, district attorneys, law enforcement, defense providers, juvenile departments, the Department of Human Services, the Citizen Review Board (CRB), Court-Appointed Special Advocates (CASA), and others as needed to assess quality of services and ensure the appropriate distribution of public defense cases.
  • Presentations to groups, such as Public Defense Services Commission (PDSC), conference attendees, public defense contractors, and court personnel, including preparation of the agenda and written materials.
  • Participate in the creation of pilot projects, including design, development of necessary policies and procedures, and evaluation of pilot results
  • Respond to inquiries from the public, outside agencies, and Judicial Department staff and judges. Examples:
  • Gather and provide statistical information for reports regarding public defense, including caseloads and cost.
  • Provide information to the OCDLA, courts, and other agencies regarding caseload and attorneys available for representation.
  • Provide information regarding application of public defense payment policy guidelines and public defense contract provisions.
  • Assist in preparing statistical reports, fiscal impact statements, and other information necessary for responding to legislative inquiries.

Minimum Qualifications:
  • A Bachelor's Degree in Business or Public Administration, Behavioral or Social Sciences, or a degree related to the agency program that demonstrates the capacity for the knowledge and skills; and five years’ experience coordinating or administering a program

  • Any combination of experience or education equivalent to eight years of experience that typically supports the knowledge and skill requirements listed for the classification.
